Invictus Lawyers are committed to protecting and respecting your privacy and we adhere to the ICO guidelines in addition to further guidelines published in the General Data Protection Regulation (EU) 2016/679 which is applicable from the 25th May 2018.

● We may also process sensitive classes of information that may include:

○ Physical or mental health details, racial or ethnic origin, political opinions, religious or other beliefs of a similar nature, trade union membership, sexual life, offences and alleged offences, criminal proceedings, outcomes and sentences.

○ Lay and professional clients, witnesses and professional experts, suppliers and service providers, complainants, enquirers, advisors, consultants, employees and anyone ancillary to actual or potential proceedings.

● Information we receive from other sources:

○ we may receive information about you from a Solicitor, Court, Cafcass, Land Registry, HM Revenue & Customs, or another party if they have any information on any matters we are dealing with for you.

How We Use Your Personal Information

We use personal information about you in connection with the following purposes:

● Fulfilling your requests, where applicable:

○ to complete any application to court;

○ to liase with other parties for any matters we are instructed on your behalf in;

○ to complete court forms and or requests from court and/or other parties, such as solicitors or Cafcass etc;

○ to complete any transaction you are undertaking with us in relation to any service we are able to provide to you.

● Service improvements and account management:

○ to notify you about changes to our service;

○ to send you emails relating to your matters;

○ to administer any promotion in relation to any service we are able to provide to you;

○ to manage and operate and escrow account you have with us.

● Legitimate interests

○ to register any interest with Land Registry, HM Revenue & Customs.

Sharing Your Personal Information

We may share your personal information in connection with the purposes described above. We only work with companies who have agreed to comply with the GDPR regulations and we may share your personal information in certain circumstances with but not limited to the following:

● Solicitors, Courts, Tribunals, Lay and Professional clients, associates of the individual, or the actual individual whose personal information we process, Barristers, legal representatives, healthcare professionals, social and welfare organisations, ombudsmen and regulatory authorities, current or past prospective employers, education or examining bodies, business associates, , trade associations and professional bodies, suppliers and service providers, employment and recruitment agencies, complainants, enquirers, financial organisations, debt collection and tracing agencies, credit reference agencies, private investigators, central government, professional advisers and trade bodies, Cafcass, Land Registry, HM Revenue & Customs, Transcribers, Private Investigators, Experts and Other Parties.

● Selected credit and/or identity referencing agencies in order to comply with Money Laundering Regulations.

They may search external sources such as the electoral roll, county court judgments, bankruptcy registers, UK credit reference agencies and education sources, where relevant, to check and assess the information you provide. These searches may be recorded by credit agencies but will not affect your credit standing.

● If we are under a duty to disclose or share your personal information in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety Invictus Lawyers, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection.

● We may share with or sell to third parties aggregate information or information that does not personally identify you, such as age, date of birth, gender, University in attendance and your hometown name.

Where We Store Your Personal Information

The information that we collect from you may be transferred to, and stored in, a country outside the European Economic Area (EEA). By submitting your personal information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your information transmitted; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

How Long We Keep Your Information

We will only hold on to your personal data for as long as necessary. This will be for up to a minimum of 15 years.

Right To Deletion

You have the right to request that all your personal data we hold is deleted. Such a request can be sent to the above address or email, where we will confirm deletion or if not possible, explain the legitimate or lawful reasons why such a request cannot be actioned within 7 working days of receipt.

Access To Information

You have the right to know what personal information is held about you by Invictus Lawyers. There is a £10 fee to meet our costs in providing you with details of the information we hold about you. The information will be emailed to you in the form of attachments where possible, and by other means at our discretion if we are unable to send by email.
